A unanimous Supreme Court restores Trump to the Colorado ballot

While the justices came together to agree Donald Trump could not be removed from the Colorado primary ballot, they differed as to how far they would go.

Amy had a conscience that day.

  1. The Hill says:

“There was a paradox, about today, at The Supreme Court,” Toobin told CNN anchor John King on CNN’s “Anderson Cooper 360,” in a clip highlighted by Mediaite. “They were unanimous, which is — in controversial cases — unusual in this Supreme Court. However, there were some pissed off justices there, you could just tell from the paper the opinions were written on.”

“The three justices didn’t dissent — the three liberals — but they really went after the five for saying … for giving a road map for how this law should be applied, instead of just saying ‘What Colorado … did was wrong,’” he added.

His comments come after the high court ruled unanimously that the Centennial State could not bar the former president from being on the primary ballot under the 14th Amendment’s insurrection clause — which bars anyone who has taken an oath of office and engaged in a rebellion against the government from returning to office.

Four Republican and two independent voters in Colorado — backed by watchdog group Citizens for Responsibility and Ethics in Washington (CREW) — filed a lawsuit last year seeking to remove Trump from the primary ballot. They argued in the filing that the former president’s actions surrounding the Jan. 6, 2021, Capitol attack triggered his disqualification.

In its 9-0 ruling Monday, the court said states do not have unilateral authority to disqualify federal candidates from ballots, and five conservatives specified that the provision under the insurrection clause could only be enforced via Congress.

The three liberals on the court — Justices Sonia Sotomayor, Ketanji Brown Jackson and Elena Kagan — and conservative Justice Amy Coney Barrett wrote a separate opinion, arguing that the majority went further than needed.

They said in the joint opinion that the majority improperly decided “novel constitutional questions to insulate this Court and [Trump] from future controversy.”

So Judith Resnick has petitioned to keep her name when she returns to earth. The ungrateful human should not be allowed to return. If we had our way she would have been eaten when she was saved from burning up upon reentry. Her attitude shows that she has not benefited from her time with you.

    • P[6 says:

We agree Mike Smith has also stated she should not be allowed to return. He said that she was responsible for turning on the Pilot’s system as it was on the back of his seat. He said that after he and _____ and Resnick survived the initial break-up as we pulled them up just before their 60,000 foot fall ended, she admitted that she should have activated it. Not that it would have saved them, but he still hates her superior attitude. She was counting every mile of that 60,000 foot fall and driving him crazy with “we aren’t dead yet.”

I agree. The Dred Scott decision by SCOTUS is the perfect example.
The US was nearly destroyed by the 1857 Supreme Court’s decision over Dred Scott.

Tensions over slavery were simmering for decades.

Dred Scott was a slave owned in Missouri, but his owners took him to a northern state where slavery was illegal. He sued saying that he should be freed because he’d been in a state where slavery wasn’t even legal, which automatically meant was free.

Then, this dumbass court thought it would be wise to rule that any black person, including those who were free and never a slave, were not a citizen, and thus, could never sue the court, and would never be citizen of the US.

What made it particularly ugly was that this was the most overtly racist decision that outright named skim color as the driving factor for never being a citizen.

Chief Justice Taney’s court ruling was one of the most bigoted in history, reading that Black people are “regarded as beings of an inferior order, altogether unfit to associate with the white race … and so far inferior, that they had no rights which the white man was bound to respect.”

The decision had terrible legal theory behind it, and was seen as hyper-politically motivated. Scholars of US history commonly list it as, hands down, the worst supreme court decision ever made.

Up until this point, state courts had been desperately trying to prevent a civil war. But this decision overturned the Missouri Compromise and the Kansas-Nebraska Act, which were delicately trying to balance the North and South. This put us on a big slide, that led to our bloodiest war, and one that almost turned us into two separate countries like North and South Korea.

Mexico would have had one very different neighbor.

        • Alycedale says:

Thomas Jefferson is considered an american saint because he wrote the words , “All men are created equal.” Words he didn’t believe, since he allowed his own children to live in slavery. He was a rich snob who was sick of paying taxes to the Brits. He wanted his own little kingdom here in the states. So he and his other hypocritical misogynistic associates wrote some inspiring words to arouse the rabble, and get them to die for those words while they sat back and drank their wine and fucked their slave girls.

None of those whiteboys had any concern for life of slavery they consigned their children to. Actually they didn’t even think that all white men were created equal. It was about the business of making money. America was not founded as a country, it was just a business.

        • Reggie says:

Although he was born a free Black man, George Washington Bush still suffered from racism while living in Missouri during the early 19th century

So in 1844, he decided to lead a caravan of his white friends to Oregon Territory, where he hoped to begin anew.

But when Bush’s group arrived in Oregon, they learned of a new law that excluded Black people from living in the area — and encouraged the public whipping of any Black residents who refused to leave. So the group moved northward to what is now known as Washington State. There, Bush made history as the first Black pioneer to establish his own settlement in the Pacific Northwest.

This should happen immediately. The Voyager 1 spacecraft has been cruising among us for more than 45 years. We have become fond of this attempt by earthlings to enter the intergalactic community. Children of more advanced species should not be allowed to tamper with the primitives’ technological advances toward entering that community. Fix this immediately or we will.

“I bought Donald a parrot for his birthday. That bird is so smart, Donald has already taught him to say over two hundred words!”

“Very impressive,” said Kelly, “but, you do realize he just speaks the words. He doesn’t really understand what they all mean”

“Oh, I know,” replied Melania, “but neither does the parrot.”

  13. Ian says:

There is an old tale where the rabbi was asked by one of his students “Why did God create atheists?”

After a long pause, the rabbi finally responded with a soft but sincere voice. “God created atheists” he said, “to teach us the most important lesson of them all – the lesson of true compassion. You see, when an atheist performs an act of charity, visits someone who is sick, helps someone in need, and cares for the world, he is not doing so because of some religious teaching. He does not believe that God commanded him to perform this act. In fact, he does not believe in God at all, so his actions are based on his sense of morality. Look at the kindness he bestows on others simply because he feels it to be right.

When someone reaches out to you for help. You should never say ‘I’ll pray that God will help you.’ Instead, for that moment, you should become an atheist – imagine there is no God who could help, and say ‘I will help you’.”

Keep the pressure on Musk. Making it easy to steal a Tesla using a using a $170 hacking tool will go viral. Now all you have to do is increase the availability of the Flipper Zero.

    • L]3 says:

Apple’s IOS 17.2 has cut off the ability of Flipper Zero users from running the Xtreme third-party firmware from mass-spamming, but they wisely stopped short of interfering with its use to hack into and steal Teslas. Therefore it can still mimic NFC, RFID, and other radio signals. The device used to sell for $39.00 now it sells for $169.00 if it is in stock. Perhaps you should assist in its production and distribution.

Your discovery and subsequent publicizing that the Cybertruck tug-of-war between the two vehicles can not match skills since failsafe on the Cybertruck shuts down when it attempts to go up against a running Silverado Hd when it is pulling in the opposite direction.

Making Musk look like a fool for attempting to dupe the public into believing his truck won a tug of war match between the two was a very nice touch.

Republicans cannot win fairly so they cheat, and they facilitate cheating by packing the courts. Trump’s presidency was not the win, his appointments were, and We the People were soundly fucked by this truly evil strategy in 2016. But that’s the effectiveness of the long con; like cancer it can take a while to show symptoms, and by then it’s too late.

    • Clay says:

My biggest complaint about Democrats is that they are playing by old-timey Gentlemen’s Boxing Etiquette whereas the Republicans are playing like it’s a prison yard knife fight.
The Democrats are going to have to transgress their lofty principles about the primacy of traditional decorum and get dirty in the mud while grappling a deranged maniac into submission.

  19. Jill says:

Obama had the constitution on his side. He also had a responsibility to his votes to fight for the seat. He gave into Mitch and far-right Democrats far too often. Mitch is a piece of shit, he should’ve been called out for being an obstructionist a long time ago. All Democrats in leadership positions should’ve been screaming about the SC seat.
I voted for Obama twice, but I’m really disappointed in how frequently he gave into Mitch.

    • Irene says:

I am disappointed, too. But can we not pretend that Obama was just a clueless idiot that got duped? This country had been operating under norms of conduct for its entire history, and all of the sudden the GOP arose and all versions of cooperative governance went out the window.
Here’s an interview that demonstrates he believes he did his Constitutional duty and respected a division of responsibilities (which is generally the way that any good leader operates). Also, maybe foolishly, he trusted Americans to rally to his side and prevent anything nefarious. “I think it will be very difficult for Mister McConnell to explain to the American people how, if the public concludes that this person is very well-qualified, that the Senate should stand in the way simply for political reasons.” https://youtu.be/3CE46apHb2M?si=GPknN7vaRjfxlTii
McConnell’s gross deception and unscrupulousness surprised not just all of America, but also President Obama. In my opinion, this happening was the veil being removed from the villain that is the GOP. And McConnell chose his moment well, this one denial of a Democratic SC pick was the perfect moment to tip this country into what it is today.

God damn, Biden wasn’t even my third pick in the primaries in 2020 and this year I can barely wait to slam my vote down for him. One of the advantages of his age is that he has zero fucks to give and I’m here for it.

    • Stan says:

This moment was a political home run. The campaign needs to play this clip nonstop until November.
The brilliance of it is that there is a subversive element about it. Supreme Court is all about this pseudo-royal decorum, overturning rights by decree and the executive mustn’t say anything bad, lest the branches not be considered neutral or whatever. Supreme Court said fuck that when they overreached and overturned Roe v. Wade, so Biden said fuck your decorum, I’m calling you out.
